Legalize Interstate Cannabis Trade Plan Unveiled by Marijuana Coalition

Legalize Interstate Cannabis Trade

A new coalition of advocacy groups and marijuana businesses have unveiled a special strategy to legalize interstate cannabis trade regardless of continuing national prohibition.

The Alliance for Sensible Markets effort will be pushing governors from authorized and probably soon-to-be legal cannabis states to enter into an interstate compact, a constitutionally recognized arrangement between at least two states, establishing a framework for marijuana to be transported and marketed across state lines.

This type of arrangement has not been attempted before for cannabis, but if the new attempt succeeds in acquiring at least two states to sign on, the compact could then be sent to Congress, where lawmakers would have the decision to codify the agreement. It might be passed as standalone laws or attached as an amendment or rider to a wider bill.

Possibly the best example of an interstate compact is that the Port Authority, which was made in 1921 to regulate regional transport and infrastructure between New York and New Jersey. Both states are now being targeted at the Alliance for Sensible Markets, even though neither have legalization on the books as of yet. California and Oregon are the two other states the campaign expects to target for participation.

Part of the logic in deciding on these states is that California and Oregon are believed manufacturer states with large volumes of cannabis, whereas New York and New Jersey are more broadly consumer states, where the climate is not as friendly to large-scale, outside cultivation.

Oregon’s governor has already provided a sign that she would be on board, signing a bill last year that would allow cannabis to be imported and exported from different states if national law or policy provides for it. Activists had hoped to find similar laws enacted in California this year, but the coronavirus pandemic slowed down that progress.

Adam Smith, founder and president of Alliance for Sensible Markets, says the group’s pitch to governors is straightforward:”We are in the middle of a historic downturn and jobs crisis, right? I believe that there’s not any other business in the U.S. private industry that’s as poised to assist the recovery.”

“With this policy change, instantly across manufacturer states, you will notice valuations for thousands of farms and companies increased by multiples, which will spur a direct wave of investment growth and job creation. On the east coast in the customer states, legalizing marijuana with interstate commerce, will mean they can get businesses up and running and stable in 6 to 18 months, as opposed to three, five, or seven years, spurring a direct wave of investment, business formation and tens of thousands of jobs just when states need them.”

Multiple groups are participating in the campaign, including the Minority Cannabis Business Association (MCBA), the New York City Cannabis Industry Association, the Craft Cannabis Alliance, the Global Alliance for Cannabis Commerce, as well as almost 50 additional companies and organization.

Genine Coleman, executive director of the Origins Council, stated interstate trade “will help thousands of farms and businesses, but it’ll be a real game changer for legacy growers in California and Oregon, where most of America’s marijuana has ever been grown.”

The group’s objective will be to draft a proposed agreement no later than December then get two governors or more to sign the agreement to legalize interstate cannabis trade by March 2021.

As it stands, transporting marijuana across state lines is strictly illegal under present federal law. The Justice Department explained such action as an enforcement priority under a now rescinded Obama-era memo designed to generally respect state marijuana policies.

Lawmakers whom have already set up the groundwork for the change in policy include Representative Earl Blumenauer (Democrat-OR) and Senator Ron Wyden (Democrat-OR). Soon after Oregon Gov.
